The Power of Personal Experience:

The Heart of PleadThe8th's Mission

At PleadThe8th, we believe that the most potent agents of change are those who have faced adversity head-on, especially when it comes to the pressing issue of youth incarceration. Our organization is not just enriched by the voices, experiences, and perspectives of those directly impacted by this complex problem – it is defined by them.

It's with immense pride that we share this fundamental aspect of our mission and vision. Our commitment to advocacy and reform gains strength from the presence of individuals who intimately understand the realities of the criminal justice system and the profound impact it has on individuals, families, and communities.

We are excited to introduce you to two remarkable individuals who stand as honorary Co-Founders of PleadThe8th, despite their current incarceration.

Their stories epitomize the resilience of the human spirit and the capacity for transformation, even when faced with adversity.

Terrence Graham occupies a pivotal place in our mission. His story is not just one of personal struggle but also of remarkable transformation and enduring impact.

His case, Graham v. Florida, decided by the United States Supreme Court in 2010, stands as a watershed moment in juvenile justice, fundamentally altering the landscape of juvenile sentencing in America. This landmark decision, stemming from Terrence's own experience of facing a life without parole sentence for a non-homicide crime as a youth, sparked a nationwide debate on the principles of fairness and the possibility of redemption.

Beyond the legal realm, Terrence's journey within the walls of incarceration has been one of continuous self-improvement and resilience. He achieved a significant milestone by earning his GED, demonstrating his commitment to personal growth despite challenging circumstances. His pursuit of education didn't stop there; Terrence has skillfully acquired various trades, including plumbing, equipping himself with practical skills for the future.

In addition to his vocational achievements, Terrence has made significant contributions to the discourse on criminal justice. He has a chapter in the new 2023 book "Mass Incarceration in the 21st Century," where he offers insightful perspectives drawn from his experiences. His keen interest and understanding of the legal aspects of juvenile incarceration make him a well-informed advocate for change.

Terrence's aspirations extend beyond the confines of his current situation. He harbors high hopes of soon joining PleadThe8th on the outside, bringing his firsthand experience and deep passion for advocacy to the forefront of the fight for justice reform in Florida. His selflessness shines through in his unwavering desire to help others, a trait that remains undimmed despite facing excessive punishments and various battles for over two decades.

Graham v. Florida, Terrence's case, established a crucial legal precedent: it ruled that juveniles convicted of non-homicide offenses cannot be sentenced to life imprisonment without the possibility of parole. This ruling recognized the fundamental differences between juvenile and adult minds, emphasizing the potential for change and growth in young people. It underscored the need for sentencing policies that reflect the unique status of juveniles and their capacity for rehabilitation, setting a new standard for juvenile justice across the nation.

This case, along with others, illuminated the unconstitutional nature of cruel and unusual punishment practices in the sentencing of juveniles, as prohibited by the 8th Amendment. The name of our organization, PleadThe8th, is more than just a title; it's a declaration of our mission and a nod to the pivotal United States Supreme Court rulings, like Graham v. Florida.

PleadThe8th's core advocacy is a plea for courts and states to cease the practice of imposing excessive and disproportionate punishments on children, punishments that far exceed the nature of their crimes. It's a call to recognize and rectify the injustices that have long plagued the juvenile justice system, where young lives are often derailed by harsh sentences that ignore their potential for rehabilitation and growth.

In the words of Terrence Graham, 'I am the 8th.' This poignant statement encapsulates the essence of our fight. Terrence, and countless others like him, personify the 8th Amendment's protection against cruel and unusual punishment. They are living reminders of the urgent need for reform and the human impact of our justice system's failures.

By invoking the 8th Amendment in our name, we are not just highlighting a legal principle; we are amplifying the voices of those affected by these unjust practices. We are advocating for a shift in perspective, urging a move away from punitive excess and towards a justice system that acknowledges the unique circumstances of youth offenders. Our mission is to ensure that the principles established by the Supreme Court are not just legal precedents but are actively integrated into the sentencing practices for juveniles across the nation.

Terrence Graham's life and legal battle symbolize the ongoing struggle for a more just and humane justice system. His story is a powerful reminder of the human cost of excessive sentencing and the transformative power of hope and perseverance.

The recent legislative move in the Florida Legislature, particularly with House Bill 1181 and Senate Bill 1274, which propose to reclassify minor firearm possession from a misdemeanor to a felony, raises severe concerns about our prosecutors' and lawmakers' underlying intentions. In addition to these concerns, the proposed legislation's handling of contraband within juvenile facilities—where mere possession of everyday items like cell phones and coins could lead to severe felony charges—further exacerbates the potential for unjust treatment.
