This comprehensive analysis sheds light on the critical inconsistencies and constitutional challenges within Florida’s juvenile sentencing framework, underscoring a decade of judicial appeals for legislative clarity and reform.


Key Findings of the Report:


• Over 40 cases in the last ten years have demonstrated stark inconsistencies in the application of §921.1402, leading to unpredictable and often unjust outcomes for juveniles.

• Courts have repeatedly recognized and highlighted the need for legislative intervention to address ambiguities and ensure equitable treatment.

• The report provides a detailed compilation of the cases, judicial commentary, and the human impact of these legal shortcomings. It does not encompass all cases of inequitable treatment but largely focuses on those where judicial commentary has explicitly called for legislative attention.
