Terrence Graham's 37th Birthday

     Today marks a significant milestone in the life of Terrence Graham, co-founder of PleadThe8th and a former juvenile lifer. On his 37th birthday, we are also acknowledging the countdown to his long-awaited freedom. Terrence's journey from receiving a life sentence without parole as a juvenile to becoming a leading advocate for juvenile justice reform is a profound transformation, and this year marks his last birthday spent in a Florida prison before his release.


Juvenile Life Without Parole 

   Over twenty years ago, Terrence’s life took a dramatic turn when he was handed a life sentence without parole for a non-homicide crime committed as a juvenile. This harsh sentence was the starting point of a legal battle that culminated in the landmark U.S. Supreme Court decision in Graham v. Florida.


   This pivotal case challenged the constitutionality of life without parole sentences for juveniles in non-homicide cases, recognizing that such harsh penalties disregarded the inherent differences between children and adults, and ignored the potential for rehabilitation and growth in young offenders.


The Eighth Amendment: Graham v. Florida


  • (2010) Graham v. Florida: The US Supreme Court held in Graham v Florida that “the Eighth Amendment does not permit a juvenile offender to be sentenced to life in prison without parole for a nonhomicide crime” banning life without parole sentences for juvenile non-homicide offenders. It emphasized the need for sentencing practices that consider the unique characteristics and potential for change in juveniles.


Resentenced to 25 Years


   However, the struggle for justice for Terrence didn’t end with this historic ruling. Despite the Supreme Court's decision highlighting the need for more lenient and rehabilitative approaches to juvenile sentencing, Terrence faced another daunting challenge.


   He was resentenced, but the term imposed was still excessively long – 25 years, starkly contrasting with the 5-year term suggested by his sentencing scoresheet, the mandatory minimum, and the state/national average of 5-10 years for similar crimes.

   This situation is reflective of a broader, alarming trend in Florida's justice system, where life sentences were being handed out disproportionately, even to children convicted of non-homicide crimes. This approach not only represented a failure to recognize the unique circumstances of juvenile offenders but also a disregard for the potential that every child has to reform, grow, and contribute positively to society.


   The fact that Florida has the highest rate of life sentences in the country, including those given to children, is a grim testament to the need for systemic change. Why are children being sentenced to die in prison for non-homicide crimes?


Systemic Change


   In the face of these challenges, Terrence Graham's story is not just a personal narrative of endurance and hope; it's a reminder of the urgent need for reform. As we celebrate his 37th birthday, we also acknowledge the profound injustice he and many others have faced – a reality that PleadThe8th is committed to changing.


HB1041 and SB930


   As a co-founder of PleadThe8th, Terrence is at the forefront of advocating for critical legislation such as HB1041 and SB930 in Florida's 2024 Legislative Session even from behind bars. These bills aim to correct the disparities in juvenile sentencing, ensuring equitable treatment for all children, regardless of a date or length of sentence.
